On Friday, February 24, 2017, a “discussion draft” of legislation designed to repeal and replace the Affordable Care Act was leaked to the public following a House GOP session. Many of the changes in the draft are focused on Medicaid or on the marketplace exchange and subsidies. However, there is an important change that would potentially impact anyone who purchases coverage through an employer-sponsored insurance plan. 


The leaked draft proposes taxing any employer-sponsored health coverage if the current premiums exceed the 90th percentile. By limiting the tax exclusion on health benefits, the government could be positioned to recoup billions in forgone tax revenue. According to sources at the National Association of Health Underwriters (NAHU), police, firefighters, and first responders would be excluded from the tax directed at health plans. Health savings accounts, vision, and dental plans are also excluded from the tax.
